The Office of the Attorney General should not be able to investigate SVP National Councillors Thomas Aeschi and Michael Graber. This was decided by the responsible National Council committee. The two had not followed the instructions of federal police officers in the parliament building.
The incident occurred during the visit of Ukrainian parliamentary president Ruslan Stefanchuk to the Federal Palace in June 2024. SVP parliamentary group leader Aeschi and his fellow party member and councillor from Valais, Michael Graber, got into a scuffle with federal police officers because they wanted to use the main staircase in the Federal Palace contrary to their instructions.
On suspicion of obstructing an official act, the Office of the Attorney General of Switzerland submitted a request in September 2024 to have the immunity of the two National Councillors lifted. The authority had received a criminal complaint.
The Immunity Committee of the National Council (IC-N) has now decided against the waiver of immunity by a narrow majority. The decision was made after a discussion by 4 votes to 3 with 2 abstentions, said Commission President Pierre-André Page (SVP/FR) to Keystone-SDA-Video.
The Legal Affairs Committee of the Council of States (RK-S) now has to deal with the case. If it reaches the same opinion as the National Council Committee, the case is closed. Should it wish to waive the immunity of the two National Councillors, the IC-N will have to deal with the dossier again.
