The public prosecutor was of the opinion that the offense of murder was fulfilled in the case of the accused, an Italian-Ivorian dual citizen. A sentence of 17 years should be imposed for this offense alone. Due to the other offenses, however, the sentence should be increased to 20 years. The Federal Public Prosecutor's Office (BA) also applied for deportation.
The public prosecutor went on to say that the conditions for custody were not met. There was no qualified danger that the accused would commit another murder. According to the OAG, an inpatient therapeutic measure should be dispensed with because the person concerned was not prepared to undergo therapy. This could therefore not be effective.
