The public prosecutors who brought the charges against former Raiffeisen boss Pierin Vincenz were not biased. This is the conclusion reached by the Zurich High Court. It dismisses the complaints against the prosecutors.

The complaints were triggered by the fact that the Zurich public prosecutor's office had the indictment reviewed by external experts before the trial. This prompted Vincenz to file a recusal request against the prosecutors.

However, as the High Court announced on Friday, it was unable to establish any bias. The appeal has been rejected, but is not yet legally binding.

The proceedings against Vincenz and other defendants were referred back to the public prosecutor's office by the High Court in February 2024 due to deficiencies in the indictment. The public prosecutor's office appealed against the referral to the Federal Supreme Court. A decision is still pending. If the Federal Supreme Court concludes that the indictment was indeed flawed, the public prosecutor's office will have to revise it and bring it back before the district court.
