The new provision of Article 90 paragraph 3ter of the Road Traffic Act can also be applied to drivers who have not held a driving license for at least ten years. This is the conclusion reached by the Federal Supreme Court in a ruling published on Wednesday.
It is clear from the legislative materials that the legislator intended the provision to give the judge a certain amount of discretion when punishing speeding offenses.
Neither the law nor the parliamentary debates indicate that the decision as to whether a driver has committed a serious traffic offense in the last ten years depends on the date of acquisition of the driver's license. The age of the driver is also irrelevant.
