Federal Supreme Court Clarification of new regulation on minimum penalties for speeding offenses
The fines that have been possible since 2023 for speeders without relevant traffic offenses in the previous ten years are also permissible for people with less experience as drivers. This was decided by the Federal Supreme Court in the case of a motorcyclist from Geneva.

The new provision of Article 90 paragraph 3ter of the Road Traffic Act can also be applied to drivers who have not held a driving license for at least ten years. This is the conclusion reached by the Federal Supreme Court in a ruling published on Wednesday.
It is clear from the legislative materials that the legislator intended the provision to give the judge a certain amount of discretion when punishing speeding offenses.
Neither the law nor the parliamentary debates indicate that the decision as to whether a driver has committed a serious traffic offense in the last ten years depends on the date of acquisition of the driver's license. The age of the driver is also irrelevant.
